Genesis Mix Lab respects the intellectual property rights of others and expects its users to do the same. This policy outlines our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act (DMCA).

1. Overview

Genesis Mix Lab provides an AI-powered audio mixing and mastering service. Users upload their own audio content for processing. We do not host, distribute, or publicly share user-uploaded audio. However, if copyrighted material is uploaded or processed in violation of copyright law, we will respond to valid DMCA takedown notices promptly.

Our designated DMCA agent receives and processes all copyright infringement notifications. We comply with the provisions of the Digital Millennium Copyright Act (17 U.S.C. Section 512) and respond to clear notices of alleged infringement.

2. Filing a DMCA Takedown Notice

If you believe that content available through Genesis Mix Lab infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, and information reasonably sufficient to permit Genesis Mix Lab to locate the material.
  4. Contact information for the notifying party, including name, address, telephone number, and email address.
  5. A statement that the notifying party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that the notifying party is authorized to act on behalf of the copyright owner.

3. Counter-Notification

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Genesis Mix Lab will forward it to the original complaining party. If the original party does not file a court action within 10-14 business days, we may restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA, Genesis Mix Lab maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. If a user is found to have repeatedly uploaded copyrighted material without authorization, their account will be terminated and they will be permanently banned from the platform.

We define a repeat infringer as any user who receives three or more valid DMCA takedown notices within a 12-month period. Account termination under this policy is permanent and non-reversible.

5. Good Faith and Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Before filing a DMCA takedown notice, please consider whether the use of the copyrighted material at issue is protected by the fair use doctrine. If you are unsure whether a use constitutes infringement, we recommend consulting with a legal professional before submitting a notice.

6. Reference Tracks and Fair Use

Genesis Mix Lab allows users to upload reference tracks for the purpose of AI analysis. Reference tracks are used solely to extract tonal, dynamic, and spatial characteristics for mixing profile generation. The reference audio is not stored, redistributed, reproduced, or made available to any third party. The analysis process constitutes a transformative use of the reference material.

Users are responsible for ensuring they have the legal right to use any audio they upload to the platform, including reference tracks. Genesis Mix Lab does not encourage or condone the unauthorized reproduction or distribution of copyrighted material.

7. Modifications to This Policy

Genesis Mix Lab reserves the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated "Last modified" date. Continued use of the platform after changes constitutes acceptance of the updated policy.
